New Machinery Regulation

DEEPENING

With the press release dated 15 December 2022, the European Commission declares that it welcomes the political agreement reached by the European Parliament and the Council of the European Union regarding the new text of the Machinery Regulation which will replace the Machinery Directive 2006/42/EC.
Specifically, in the Regulation, it is envisaged that 6 categories of machinery are compulsorily subjected to conformity procedures by a third party (the Notified Body) which will issue a certificate of conformity; machinery that does not fall into these six categories are subject to the manufacturer's self-assessment of conformity procedure.
The objectives of the New Machinery Regulation can be summarized as follows:

  • Greater safety of the machinery placed on the market
  • Legal certainty
  • Minor charges to be borne by the manufacturers
  • More effective market surveillance system

The European Parliament and the Council have formally adopted the new machinery regulation which will probably be published in the Official Journal of the European Union in the first months of 2023. The regulation will enter into force on the twentieth day following its publication in the Official Journal of the European Union and will apply 42 months after the date of its entry into force.
