Overview of the Brazilian Market

Industrial machinery imported into Brazil are subject to specific rules and technical restrictions.
 
In fact, Italian and European manufacturers must respect local safety requirements set by the NR 12 Brazilian Regulation "Segurança no trabalho em máquinas e equipamentos". The NR 12 Brazilian legislation is the main Regulation - but not the only one - that defines the technical and documentary safety requirements of the machinery; this standard is applicable to both new machinery and to machinery already in use (old machinery).
In accordance with the NR 12 standard the sale, construction, exhibition and use of machinery that do not comply with the requirements of Brazilian NR 12 (and other Brazilian regulations applicable to machinery such as legislation Brazilian NR 10 and Brazilian regulation NR 12) are prohibited.
 
If a company uses machinery which is not in conformity with NR 12 obligations, the Inspectors of the Brazilian Ministry of Labor (Auditores) impose heavy sanctions and measures.
 
For these reasons, the Brazilian company are paying more attention to the compliance of the machine with the Brazilian regulation NR 12 in the final testing phase. If a machinery is not in conformity with NR 12 safety requirements the Brazilian company shall ask:
 
  • The adaptation to safety requirements, or
  • The cancellation of the order
  • Delay of payments
